    Stopping Payment on a Check for Services
    What is the statute in Florida regarding "stop payment" on a check? Isn't it illegal to put a "stop payment" on a check for services? thanks

    On a concrete job, the slab is poured, floated, & finished for a patio according to specs. & the job order - the customer pays as agreed when the job was finished, only to put a "stop payment" on the check.........

    If the customer did not have the funds and placed a stop payment, it would be fraud and a criminal offense.

    If the stop payment was placed for a legit reason, like defects that appeared later, then it would be a matter of working it out civilly, in or out of court. I doubt the state attorney would do anything. However the burden of proof is on the customer and it better be good.

    Although you can go to the police, most offices of the state attorney in Florida have bad check sections that can advise you, investigate and prosecute if necessary.
