    My question involves a speeding ticket from the State of: Washington

    I was issued a speeding citation for going 54 mph in a 35 mph zone. When the deputy told me how fast I was going (based on his radar display), I told him it didn't seem that I was going that fast. He indicated that I shouldn't be taking the corners on this road at that speed.

    I have 6 witnesses in the vehicle that said it was impossible that I was going that fast, because the luggage in the van would have been thrown everywhere, and taking the corners at that speed, would have been noticeable by all the passengers.

    When I first noticed the deputy, he was traveling the opposite direction. As soon as I saw him, my first instinct was to check my speed; both speedometer and my GPS indicated I was driving 45 mph. Perhaps the deputies radar display read 45, but he saw 54.

    I plan on sending in my ticket, and checking the "Not Guilty" box. I am pleading not guilty to driving 54 mph in a 35 mph zone.

    What should I do after mailing in the ticket?

    I've noticed that 25 members have viewed my post, but no one as replied. Was there a problem with the manner that I posted? I plan on sending in the ticket as contested on Friday, August 14.

    If you spent any amount of time READING threads on this forum, you would have come across, literally, DOZENS of answers to your question. This one, for example, starting with about the fouth post gives a pretty good outline of the steps you should consider taking.

    I am trying to keep to the first thread I created. I have already made my request for discovery, and received a response from the prosecutor's office, but so far not from District Court; my question is do I just wait until the hearing, or do I contact District Court, asking about the documents?

    The instructions for discovery didn't indicate this, but should I also send request for discovery to the sheriff's office as well?

    My day in court quickly approaches (Oct. 21).

    Pursuant to IRLJ 3.1 (b), you are NOT entitled to ANY discovery except the officer's sworn statement and a list of any witnesses not included therein.

    By documents from the District Court, I assume you mean the SMD certificate. If you want to see the SMD certification, you must CALL the Clerk of the Court to see if they can mail or email it to you -- although they are under NO obligation to do so. If they will not send it to you, and you REALLY want to see it, your only recourse is to go to the courthouse to view/copy it (see IRLJ 6.6 (d)).

    The Sheriff's office, likewise, has no obligation to send you anything.

    So, what I should do is show up for court, explain to the judge that I asked for discovery, show the judge my copy of the discovery request (showing proof of delivery), and explain that I have not received the requested documents, and explain that the deputy showed point of contention when he checked SMD after giving me the copy, and ask that the charge be dismissed?
