    Overpaid After Resignation
    My question involves employment and labor law for the state of: California

    I resigned for a school distruct in June 2009. I gave them 2 months notice.

    They direct deposited an additional check into my account (by error) I have spent the money (I had not reconciled my books until this week) They are calling and emailing and harassing me.

    Do I have any legal ground to stand on. I will not be able to return the $ until end of Sept as I teach and do not get paid until then.

    Advice?

    Agree with cbg. How could you not know you were spending money you weren't supposed to have? Do you not keep a checkbook register? Paying bills online is a good way to be reminded of how much money you have in your account; every time you log on, you see your balance.

    You can ask the employer for a deduction agreement effective when you start getting paid again. OTOH, they could sue if they choose to. Do not ignore this.
