In-House Background Check
My question involves a background check in the State of: Texas. I recently applied for a job at a company in Texas. After going through the application process, I interviewed with two of the managers. The second manager said that he felt that I would be a good fit and even offered to let me start working that day. I had other things to take care of that day so I decided to just start on the following Monday. He said that was fine and asked I wanted to go ahead and fill out the employment paperwork. I said that I had another appointment that I needed to get to and would take it with me and bring it back on Monday. I gave a verbal consent to start a background check, which they ran. Later that day I received a phone call from the hiring manager and was told based on information in my background check that they would have to revoke the job offer. The next day after learning about my right to a copy of the report, I called and requested a copy of this report and was told that it was the property of the company and that would not give me a copy of it. I have since contact the company anonymously and asked whether they used a third party or did the background checks in-house, and got the response that they did they in-house. My question is what recourse if any do I have at this point?
Re: In House Background Check
Little if any. If they did the check inhouse you are not entitled to a copy of it, and revoking the offer does not violate any laws. It's only if a third party handles it that you are entitled to a copy.
