    Michigan Controlled Substance Act 333.7411
My question involves criminal records for the state of: Michigan

    Greetings,

I was arrested in 2005 for possession of controlled substance <25 grams. Was allowed to plead guilty under 333.7411. Successfully completed all probation requirements. Have order of discharge of probation in front of me that says that "record of arrest and dismissal shall be retained as non-public record".

I just paid for a background check from Michigan State Police Internet Crime History Access Tool (I-Chat).

All information about arrest, charge, and adjudication are available in this search. I have read 333.7411 several times and this clearly shouldn't be happening. The last entry in the judicial segment of the search shows the case was deferred under 7411 but there is no reference to dismissal.

I wonder if the record wasn't updated when I was discharged from probation? What can I do about this?

    Thank you in advance,

    As is explained here,
    Quote:

Quoting What can be done if the person claims the record is incorrect?
If there is an error on the criminal record in the judicial segment the person must get a copy of the disposition from the court and send both a copy of the record in error and the court form to the Criminal Justice Information Center. If there is other data wrong, the person can call or write The Criminal Justice Information Center to advise of the discrepancy. The Criminal Justice Information Center will contact the reporting agency to verify the correct information and correct the record.

Thank you for your reply. What do you mean by "court form"?
