What Do I Need to Fight Protection Order in Washington State
I live in Washington State and have been served an order of protection by my soon to be ex wife. We have no children together and have been married for 6 years. In it she states that I demanded sex from her and when she refused I attempted to force her. The second Allegation is that I threatened to shoot her and she fled the apartment in fear. She also states that I was verbally abusive to her. The first allegation is absurd because I have survived 3 strokes and walk with 2 canes. I obtained a statement from my doctor that I am limited physically and have difficulty walking, standing,climbing stairs,kneeling and ambulating. One look at me moving and anyone with common sense would say no way. I also suffer from erectile dysfunction and we have not had sex for 7 years. I tried to get a statement form my previous doctor on this but he is on vacation in India, and the trial is this Thursday 8/6/2009.
The second allegation is a lie and my son (he's 20 and lives in the house also) was there when this supposedly happened. The cause of this behavior was that I received a $712.00 cable bill of which over $400.00 were for international calls. I informed my wife I was canceling the international calling feature and she became very angry. This wasn't the first time she ran up a bill like this. The night she alleges I threatened to shoot her she put on her jacket and left saying "I'll show you who you're messing with". She stayed at a friends house that night and the next morning she came back to the apartment with the building manager, showered and left for work. She was off work the next day and the police arrived that evening and served me with the order. I have a letter from my former pastor detailing how she asked him to deposit her income tax check in his bank account so I wouldn't find out about the money ( I was recovering from the third stroke at the time and was unemployed, I was finally forced to go on public assistance) and that he was counseling us for a troubled marriage. She has hidden my canes and locked me out of the bathroom at critical times resulting accidents and embarrassment. My son witnessed all this. My question is what other proof do I need to get this order lifted. I am staying in a hotel and if I can't get the order lifted I will be on the street. I am out of money.

We cannot tell you what's going to happen in court, what the witnesses will say, or how to anticipate every possibility. You know what you plan to say; get your evidence and supporting witnesses together and prepare to present them in court.
You would be well-served to hire a lawyer.
