Divorce Judgment
My question involves divorce in the State of: Oregon
I just learned that my husband's ex-wife is moving out of the country. He owes a monetary judgment from their divorce that we have yet to pay due to financial struggles. We most certainly cannot afford international postage as well. Knowing her, chances are she won't give us a forwarding address to send her anything when we can finally afford to. She didn't when she moved to another state, so why should we expect her to do so when she leaves the country?
What are our options in this situation?

If he wants to pay her and is worried about his ability to do so after she moves, he is free to pay her before she moves.
Seriously - you're using international postage as an excuse? And you think she's going to make it difficult for him to send her checks?

That's just it. He doesn't want to pay her, and couldn't take that advice even if we could afford it. It's around $4K right now--if I had that kind of money to throw down like that, she wouldn't even be on my radar right now.

She made it difficult when she left state last year. Didn't even give us a forwarding address until I threatened to confront her in front of all of her friends about it when she briefly came back to town, and even then, it was a PO box. Because she didn't want me to go to her house. Yeah, like I have the money to do THAT, either.

We don't like her. She's a lying, vindictive, manipulative person. She's done nothing but spread vicious rumors and threaten us at every turn. She knew he would never be able to afford the judgment, but she pushed for it anyways, and even got 9% a month interest. She made it hard for him to get a job by charging him with domestic harassment, and he had no way to fight it, so now he has a criminal record because of her. She even got me fired from a very well-paying job--which WOULD have ensured her having her money before last Christmas. Does this really sound like a person that deserves ANYTHING out of my pockets other than lint and gum wrappers? Or really wants it, for that matter? Believe me, if someone owed me that kind of money, I would be making sure they were working, and not preventing them from doing so. I would also be considerate enough to let them know before a big conflict broke out to tell them where they could send it. Her mother offered to let us send it to her instead several months after the judgment was issued (fall '07)--the ex moved several times in town, then left state last fall, and we didn't get any kind of forwarding information until April this year. Yeah, she really wants my money.
I'm already doing my research, but I figured I'd get some kind of input in the right direction, despite a friend telling me not to waste my time on this forum. If I can't get anything that's not saying that I coming up with excuses (because not being able to afford it in any facet--international postage included, seeing as I can barely afford a domestic stamp right now--is a big cop-out) by the weekend, I'm just going to call my local legal aid. Even considering not posting this reply. Eh, what the hey, maybe I'll get something more constructive.
Mr. Know-It-All, I sincerely hope you aren't a lawyer, because if I had gone to your office and gotten that answer, the only thing you would be seeing from me is my rear end going out your office door. But, then again, if I could afford a lawyer, SHE would be owing ME money. And postage to AU is $2 at the cheapest.
And, don't worry. If I find something more useful, I'll let you know.

oh, wait, here we go--according to USPS, I can only mail a check internationally if I pay for Registered Mail, the total for postage and the extra service being $13.32.
Does that help any? I most certainly cannot afford THAT every time I go to mail her something.

I've just been reading up on this, if a real attorney has a better answer, let me know.
What does it say on the judgment order? To be paid directly to her or to the court? If its to the court...then there's your answer. If its to her then you must go by the address on the court documents unless she files a change of address notice with the court. Otherwise, send the payments to that address, on schedule with signature confirmation. That way when the money gets returned to you, at least you can say you tried. Keep all the proof.
Then file a motion to vacate the order or appeal the judgment. When she doesn't show for the hearing...you win.
Anybody got anything better?
