Vehicle Possession

This is in Michigan. I am going through a divorce. There are two vehicles. One is my truck that was owned prior to the marriage. It is in my name only. Then there is a Ford Escape that was purchased after the marriage. How ever the financing, title, registration is in my name ownly.

My soon to be ex, has posession of the Ford Escape. She refuses to return it. There is no court resolution as of right now.

How ever I am finiancially responsible for the vehicle. It is not paid for in full yet. What are my options in this position.

As well, while the vehicle is in your name only and the financing is in your name only, I would suggest the payments were from marital community property and as such, gives her a claim to at least some equity of the vehicle.

I was the sole provider, she did not work while we were married at all. I paid all the bills out of the money I earned. I purchased the vehicle so she would be able to take my son to doctor appointments and what not. As well as to have transportation so she was able to obtain work. Which she never did.

So for the last 2 years I was paying for this vehicle.

Because her credit she will not get approved to take over the loan.

I have no problem selling the vehicle.

Also to add to this. All payments were made from a checking account solely in my name. My pay check would be direct deposited into that checking account. At no time did we ever have a Joint checking account, or credit cards or anything of the nature.

We just never got around to having a joint accounts.

so, basically you are saying she provided nothing of value to the marriage?

and you did not provide how you addressed the vehicle in the divorce petition.

It states she will have ownership if she can be approved financing or can come up with the amount for pay off.

Basically she has to by it from me for pay off.

When we first began our relationship she worked. Then when she got pregnant, she was terminated from one job for so called work performance issues. The place wanted her to do things against medical restrictions. So they terminated her for it.

The other job she had the time laid her off and never called her back. But replaced her with someone else with in the company.

But nothing can be done about that because Michigan is an at will work state.

So once we got married that was it all she wanted to do was sit at home and do nothing. Laundry was not getting done, house was not getting cleaned, nothing was getting taken care of unless I took care of it.

When my son was born things even got worse. Then on Nov. 14th 2008 she moved out. She did this while I was on a planned hunting trip. She packed up and took my son and moved out. Did not inform me of this until I returned from my preplanned hunting trip on Nov 20th 2008. I did not even know of her intentions to move out till I returned and was informed of it. Then she tried to keep my son from me when I returned. Which didn't work out in her favor. Because I called the local sherriff and they came out. I then was able to get my son for a couple days. Since then I have been getting my son weekly with a couple over nights.

The only reason the divorce is not final yet is because she refuses to agree to my conditions of visitation. Which are every other week.

Basically I had everything, house, vehicle, money, stable job. Yes she took advantage of me and I was blind to the fact.

When we first began our relationship. She was working two jobs, had a good car. But shortly after our 2 years of the relationship. Her car got repoed, so I got her a decent used car. But then she got pregnant. Which the decent used car, the car seat would not fit in the back seat of. So I traded it in and got an 04 Escape for her to drive.

There is an aggreement that no one else would drive the vehicle. On several occassions I caught other people driving the vehicle. I currently have the vehicle back in my possession. So it can be repaired for an oil leak of the engine. How ever the registration expires in Sept. She has another car she has been driving. Whose name it is in I do not know. She has had this other vehicle for about 4 months now.

You really took that the wrong way. I was implying that a stay at home mother does provide a value to the relationship. Just because she did not work does not mean she had 0 contribution to the relationship.

I see from the rest of your post that she did contribute minimally but that was definitely not where I was going with that statement.

Pay off is at or less then FMV. It is not higher then FMV.

Pay off currently is 9,000 it blue books for 10,500.

She contributed more before the marriage then she did during the marriage.
