    My question involves divorce in the State of: California

    Hi,

    How is spousal support decided when the wife in this case has been on permanment disability for over 10 years? During the course of the marriage and during the separation and now finally the movement into the divorce, The soon to be ex-husband, has been giving money to the soon to be ex-wife since separation, more than a generous amount. He has had to recently reduce that amount, with no court order due to a reduction in his own income. The difference in income between the two are about $800.00. He grosses about $800.00 more and she recieves tax free disability. How does the court look at her steady income for over 10 years when making a decision for spousal support. The soon to be ex-husband again has been giving her $$$$ this entire time, after orginally filing, almost 5 years ago, to now that he has started the paperwork.

    Please any advise would be greatly appreciated.

    What one person thinks is generous another may think of as miserly.

    Was there a court order for him to pay the original amount? If not where did that 'generous' figure come from?

    In CA you must wait 6 months from filing to have the divorce finalized. Why has this taken 5 years?

    How long were they married before they filed?
