You should read this. Even if he qualifies for and obtains a dismissal, the record doesn't go away - it simply states that the charge was dismissed instead of saying that there was a conviction. What exactly is it that he hopes to accomplish? Has his military recruiter told him that he will be able to re-enlist if he gets a dismissal?

Thank you for responding. In Delaware if we file a petition for expungement it takes it completely off the record, like it never existed. Does CA have something to this effect? If not, I guess we can go after the dismissal. He went a couple of years ago and it showed up and they wouldn't let him re-enlist. He hasn't tried since then so we really don't know what the recruiter will say if he has a dismissal on his record instead. But he had to get a security clearance for his job to be able to do some work in a prison here and they couldn't let him on the premises b/c of this charge.
