Robbery Charge and Background Checks
My question involves criminal records for the state of: ILLINOIS
Hi, in the past I was arrested for retail theft, which was my first offense and they told me it was a misdemeanor, I was never asked to go to court for it or paid my civil demand; basically never was charged for it, and this was when I was a juvenile. My second arrest was a class 2 felony robbery charge, I am still going to court for it, right now. They are getting me for a Class 2 Felony for robbery as an adult.
A relative spoke to my lawyer and he said that it will show up on my background check because the court has already registered me in and all this stuff, but other people tell me nothing will show up until the case is closed and has been settled.. so I'm not sure what to think.
My question is when jobs do a background check on me, will my robbery charge show up or my other arrest?
Thanks.
Re: Robbery Charge and Background Checks
You can be almost certain that it will. Yes, by the other responder, is a good answer.
Re: Robbery Charge and Background Checks
Okay well there's also this other woman who is in charge of my curfew/drug drops and whatever i do wrong she tells the court... kind of like my probation officer(pre-trail service) but I'm not really on probation yet. She said when I apply for applications that I should put 'NO' if they ask if I'd ever been convicted of a felony because she said I am not convicted yet because I'm still going to court for this incident.
So one more time, you guys are most likely sure that it will show up on my background check??
Thanks for all the answers!
Re: Robbery Charge and Background Checks
The lady telling you put no because you haven't been convicted yet is right as long as the question asking just about convictions. As the other have stated it will most assuredly show up on a background check.
Re: Robbery Charge and Background Checks
Well you guys were right, it did show up .. :wallbang:
Say I get convicted of a felony and I later see if I can even get it expunged.... then once it does get it expunged, will it clear my arrest record that shows up on background checks also or will that still be there? Because I understand that with expungement your conviction is rid of but I wasn't sure about the arrest records?
Re: Robbery Charge and Background Checks
I also forgot to mention that the job is sending me a letter since they found something in my background, from the corporate office .. im not sure what that letter is going to say and is it possible i could say something to them such as how i am fighting the case and haven't been convicted to actually get the job or do they only look past it if I were to actually show papers for expungement (from what I've heard) ?
thanks for all the help
Re: Robbery Charge and Background Checks
Anything's possible. Nothing's guaranteed.
Re: Robbery Charge and Background Checks
Agree that anything is possible but I wouldn't get my hopes up too high.
Re: Robbery Charge and Background Checks
Just curious .. when someone gets an expungement on a criminal record .. do all the websites that do background checks update there
database or do they keep record of when the person was convicted even though he or she got an expungement on it??
Also when someone get's an expungment does there arrest record clear too? as well as their conviction or only the conviction ??
Thanks for all the helpful answers .
