    Retail Fraud, 1st, 2nd, and 3rd degree
    Hi...can anyone explain what the hell the different degrees mean? i know it is for the amount of goods taken, but which is the least serious?

    Retail Fraud in Michigan
    1st Degree Retail Fraud - $1,000 or more stolen; or 2nd Degree retail fraud with a prior conviction - A felony punishable by up to 5 years and/or $10,000 fine (or three times the value of the merchandise)

    2nd Degree Retail Fraud - the amount stolen is $200 - under $1,000; or 3rd Degree retail fraud with a prior conviction - a misdemeanor punishable by up to 1 year and/or $2,000 fine (or three times the value of the merchandise)

    3rd Degree Retail Fraud - less than $200 stolen - a misdemeanor, punishable by up to 93 days and/or $500 fine (or three times the value of the merchandise)

    Would you know if it is a third degree....worth $65....would it be stilll considered a CIMT (crimes involving moral turpitude). Can I talk to an attorney to not have it on my record even if I plead guilty.

    PLease help!!

    Shoplifting can constitute a crime of moral turpitude, but a shoplifting conviction can also fall under the "petty offense" exception when evaluated by the USCIS.

    You should discuss your situation with a criminal defense lawyer who is familiar with immigration issues, in whatever state the charges are pending.
