i recently was visiting a freind out of state when i was caught shoplifting.the cops where called and i was arrested. the officer asked me if i ever been arrested for shoplifting before and i told him no.the problem is i have been convicted for shoplifting in my home state of california. my question is when i go to court for this are they going to know about my record in california?
If they took your fingerprints and ran them through the FBI NCIC database, then yes they will know. The prosecutor will know. There is an outside chance they might not bother with that minor of a charge but I would not bet on it.
They may know about your record; depending on what you're charged with, though, it may not be an issue until sentencing. I suggest not lying about your record during court proceedings or when meeting with a probation officer.
