When Can a CSC 4th Degree Misdemeanor Be Expunged
I am seeing this guy and it is pretty serious and about 6 or 7 years ago he was charged with a Criminal Sexual Conduct 4th degree misdemeanor, he served no time and/or paid any fines. He does not have a couple traffic tickets on his record that have been taken care of (2001 and prior) and child support issues that were taken care of as well other than that he has a clean record.
He has legal guardianship of his two daughters and I have joint physical custody of my two daughters and would like to start a life together...what can we do? I don't want my ex starting anything if he were to find out
Thank you for any information that could help us out?!
Re: When Can a CSC 4th Degree Misdemeanor Be Expunged
Define "traffic tickets". If you mean traffic misdemeanors, they're not expungeable of themselves and as prior criminal convictions they disqualify him for expunement for any other offense.
Otherwise, as the statute indicates (MCL 780.621), he can try to have his record expunged following a five year waiting period. The expungement of his criminal conviction, however, will not change his status as a sex offender if he's subject to registration laws (MCL 780.622). If he was a juvenile at the time of his conviction, and is still subject to registration requirements, he may be able to get that requirement lifted.
