Pre Trial Diversion for Possession and Paraphernalia

My question involves criminal law for the state of: TN

They have gave me a pre-trial diversion after the Trooper vouched to my public defender that he beleived it was not my weed or pipe! The reason is because it wasn't, the day I got pulled over it felt like a calamity. I have never been in trouble before, NEVER! An have never smoked pot NEVER hah! But my buddies do, which explains the less than a gram of pot and a pipe found in my vehicle that day I got pulled over! Not only did this trooper vouch to my public defender that it wasn't mine HE LET ME GO THE DAY I GOT PULLED OVER! See I was coming from a funeral in KY and heading to Birminham AL and I was stopped for an 80 in a 70! Then he proceeded to say I was being sketchy and wondered how my friend died. He died from a overdose, and this was the reasoning of him asking "May search your car." I didn't so no, I laughes and said check under the hood and trunk, whereever I do not mind! He ended up finding a pipe and a small amount of weed in a pill bottle under the passenger seat! Now this happened in Jan of 09 and I have still not been judged by the judge! Today I go to court with a clean record and facing a pre-trial diversion! The question I have is, why should I be charged for something that the trooper does not believe is mine. An the TN state law says with two ciatations like that I must be locked up and my car towed off. HE LET ME GO! This is a calamity like I said and angers me tremendously!

The law probably says if it's in your car,nothing knowing it's there still makes it illgeal. The fact you were the only one in the car he charged you.Hopefully you can get in the diversion program and avoid a record.Next time make sure nothing in your car,it's suxs I techinally they had a right to bring you to court.

Its final I got a $900 fine and probation for a year and they say it will be on my record till the year is complete... So when I go back on at UPS after being laid off they do another background check it like their urine test cause the union keeps us from peeing in a cup! WILL THIS SHOW UP ON THE BACKGROUND check for this job or any job for that matter!

It depends,I might not show,it might show what you were charged with and then say dismissed next to it. After a year you can legally asked no to the question,have you been convicted of a crime.
