3rd Degree Misdemeanor Assault
My question involves criminal law for the state of: Nebraska
This happened between myself, my roommate of 2yrs(guy) in our own apartment.
About a month ago in my apartment me and my roommate ended up in a confrontation due to what started as a verbal dispute. It escalated to the point where he swung at me, I ducked and then tackled him. Upon this I punched him a couple times in his back and his head. Cops were called by our third roommate and upon their arrival I was given a citation for Assault Misdemeanor(3rd).
Since this time as this was about a month ago, my roommate and I are both still friends, he didn't press charges, nor did he receive any injuries except a slight headache and a bruise on his back.
At my court hearing I was told I was being charged with 3rd Degree Assault and Disorderly Conduct(which I am not sure why)
My question is that at my future trial, what are the possibly sentencing? I have no criminal history at all, I do not even have any driving tickets. My friend in which the altercation was with states he is willing to help clear my name, but I am still worried about what I could possibly be sentenced.

If you wish to take your case to trial, I suggest working with a criminal defense lawyer.

Speak to a lawyer and see if your friend willing to help if a dismal is possible.Since it's your 1st time you will probably just got probation.Hire a lawyer and see if they get the charge dismissed or reduced,maybe a diversion program is possible.

Your roommate does not have the authority to decide whether or not you are prosecuted.
When the police were called and the assessment of the situation was made, the DA makes the call from here on out.
