Getting Rid Of a House Mate
Me and 3 others decided to rent a house. Me, my boyfriend, roomate 3 and roomate 4 . Me and roomate 3 had the lease based off of our income as the 2 boys have horrible credit and do not make much money. It was agreed by all that me and boyfriend would share master bedroom and the other 2 would each take 1 of the 3 rooms up stairs. The extra bedroom would be a game room in which we have already purchased equipment for this room. Almost $1000.00 between me and roomate 3. Since then me and the boyfriend have been on shakey grounds and we all agreed it would be best if he did not live there anymore. Roomate 4 is moving out in June so the boyfriend has been asked to leave then as well and we are letting him stay in bedroom 4 untill then which is when the gameroom equipment will arrive. The landlord said me and roomate 3 will still be liable for the rent as it is based off of our income if the boys leave. Therefore they can not be penalized if they broke the lease early it would just stick me and roomate 3 with the full load of rent. Which actually is ok with us. The problem now is that the boyfirend does not want to leave at all now. He said since he signed the lease he will stay there as long as he likes. I am not looking to kick him out on his butt however I and the others want him to go. (they are willing to do what is necessary to get him to leave as well) I guess Question 1 would be how can we get him to leagally move? Question 2 since both boys are paying less rent then the girls can we give notice that rent is going to be divided up equally between the 4 of us? Thank you for any and all help.

If he's on the lease, you probably cannot make him move just because you don't want him there any more. If he's on the lease he's your landlord's tenant, not yours.

If the lease doesn't dictate how rent is divided, you can agree to divide it any way you choose. However, don't count on being able to throw anybody out if they don't agree to pay more than was previously agreed.

    Master Tenant
What if there has been a master tenant designated by the Landord?
