    My question involves criminal law for the state of: California

    I was falsely accused of having an inappropriate relationship with a student -- I'm a teacher. The allegations were brought on by a student who told our campus officer. The allegations are not true. This student (girl) who made the allegations is obsessed and very jealous of the student she is accusing me of having an intimate relationship (male). The student in question is 18 years old. My student has came forward to me and told me that he was being harassed by the female student because she is jealous and under the impression that she is his GF. Anyway, I helped the student by talking to him and advising him to talk to this girl and be honest with her etc.

    I am good friends with the students family -- his parents. I talk to the students mother on a regular basis. I am a family friend. My student would spend his lunch in my classroom (as did other students and teachers) because he did not want to deal with this girl and her jealously towards him. This girl was upset that he would not spend his lunch with him and was in my classroom. One that girl came in my classroom to tell me to leave my student alone or she will go to administration with rumors. I let administration know of her intent right away. However, she went and told our campus officer (who has a reputation of breaking the rules) that I was having an inappropriate relationship with my student.

    These allegations came at the end of the school year -- somehow I was also accused of having inappropriate relationships with 6 other male students by this one girl student. I was put on a leave with pay for the rest of the year. The case was reported to police and a police detective is doing an investigation. Students were called and they all said that these rumors were not true including the student that I'm being accused of having a relationship with. I'm very close to the parents of my student and they have been supportive - I have helped this family tremendously. They consider me a close friend of the family. Since this happened I have not visited the family or anything due to fear of what is happening.

    Obviously I was a mess at the time and communicated with my lawyer only. The detective called me to come down to answer questions at the police station. My lawyer called her back and the detective told my lawyer that she feels that the case is going nowhere because students are saying it's not true that unless someone comes forward with some incriminating evidence that it will go nowhere.

    My question though is when will I know if this case gets closed? Or will I ever know? No evidence exist that any of these accusations were true at all. Now, if I hang out with the students mom (we are friends) will this be used against me? I'm close to this family and don't want to be afraid to see them when I have done nothing wrong? My lawyer said to move on with my life but it's hard. My life has been crazy since then and I feel like I have to change my life around due to students false allegations. Not to mention that students during school and staff were talking about these allegations and I'm being seen as a monster.

    The case will be closed when the police close it. We have no way of predicting that.

    You should be consulting a lawyer about what you should and should not do, but it seems like common sense that you wouldn't want to be hanging out with students who are the subject of these rumors while the matter remains unresolved.

    I know what you mean but it just seems insane that a jealous girl can say lies and there's no consequences on her but I have to alter my life. The student admitted to my students mom that the reason she did that was because she was mad and she does not regret it because it as no consequences on her. However, I understand the common sense part -- and I've had no contact but do I have to avoid my friend (mom) for the rest of my life? Insane. Yes, I will contact my lawyer.

    Yes, I contacted my Union Rep see the thing I'm a probationary teacher and I got a pink slip so as of right now I'm not returning to the district. I'm fully aware that the district if they wanted could report this to the credential office. Typically, the district did not investigate the matter because it was the end of the school year and I was going off their payroll.

    From what my union rep told me the school district does not call the police but since the student told the cop he had to report it.All students said that those allegations were false and since the student in questioned denies anything like that ever happened -- what more do they want? My lawyer told the detective that I will not be giving her statement because it has caused me too much stress and the detective told her it was fine. That since my student in question denied all the allegations that the detective feels its going nowhere unless someone comes forward with hard core evidence. So will this case just remain open??? If they found NOTHING why won't they close it??? It just makes no sense. Anyone then can make false accusations on u and torture you like this even though the investigations yielded no evidence?
