Custodial Parent Refuses to Come to Child Support Court With Minor for Visitation
My question involves a child custody case from the State of:Illinois After 10 yrs of not knowing, mother brings me to court (illinois) for child support. Dna test is conclusive im the father. While Prose and after some extensive background checks its found she is married to a registered sex offender (RAPE, BURGULARY AND DEVIANT CONDUCT). The courts have tirelessly requested that she bring the child to court for a visitation schedule and emergency intervention with the child and she has ignored several court orders even after being served by the sheriff. What are my legal options as i cant afford a lawyer, and the judge is furious with this non-compliant mother. She has been found in contempt of court with an body attachment. I want to see if the court will honor the request to temporary halt child-support payment to see if she will then come to court with minor and pursue $ again or what are my chances of joint or full custody? Currently i have legel and full custody of 2 of my children. PS i also have evidence that the sex offender has interfered with her receiving mail. PLEASE HELP I NEED TO HAVE VISITATION WITH MY CHILD!

Is your goal to get custody or enforce visitation, or to end child support? If it truly is the former, consider asking the court to let you escrow child support until she shows her pretty face in court. If you ask the court to terminate support, and your goal is actually to get more contact with the child, you may send the wrong message.
Asking for modification of custody is a valid approach - if you in fact want custody - when the other parent is ignoring court orders for visitation and is actively impeding a parent-child relationship.
