Out of State Marijuana Possession
My question involves criminal law for the state of: Michigan
While visiting Michigan me and a friend were arrested for under a gram of marijuana each (First offenders in 20's). We are going back for arraignment in Michigan from out east, we are hoping the magistrate will deal with us in one day because we have to drive so far, if we plead guilty is that possible? Is it worth pleading not guilty in order to make a deal or get a reduced sentence? And lastly can they give us probation even though we live in a state where it is decriminalized (MA)?

The court isn't interested in how far you have to come. For your best outcome, you'll want an attorney present. MI max penalties are here.

Pleading Not Guilty is the only chance you have of getting a reduced sentence. If you plead Guilty, you tie the court's hands, and trash any chance you might have at a reduction. Plead Not Guilty. Be certain to have a lawyer. If you can't afford one, ask for a Public Defender.

Of course they can. You were busted in Michigan, Michigan laws apply, and where you live is irrelevant. "When in Rome, do as the Romans do" isn't just something people say.
