Possession in Florida

My friend and I were pulled over for not having our headlights on. The officer came up n claimed he smelled marajuana. He soon took my friend out of the vehicle. Then took me out of the vehicle. Searched me without first searching the car which I think violates my right. Then searched my friend. Then he doesnt ask to search the car, but searches it anyway. Finds paraphernalia in my pockets, with about .3 grams of weed. Then finds about 9.7 grams in my friends car. Arrests us both. Then on the report he puts i am charged with 3.1 grams and paraphernalia. He charges my friend with 10.9 grams of weed. Lets us go with a court date. What should we do or expect? This was in the state of Florida.

He searched you first so that he could be sure you wouldn't pull a gun and shoot him in the head while he searched the car. Where did you get the notion he had to search the car first? Think about that one for a minute.

Once a cop smells mariajuana, which is quite distinctive and 98% of people alive could identify, he does not need your permission to search anything in his presence including the car. So it sounds like a solid bust and conviction so far. None of your rights have been violated.

He will have put the evidence into an evidence bag and some lab tech will likely weigh it and testify as to what it is and how much. Amount won't matter in the amounts you're talking about because it is all under 20 grams. Possible jail time is a year, possible fine is $1000, but if it is a first offense you won't be doing any jail time unless you act like a jerk. Get a lawyer and you'll get a fine and some probation.

First offense usually with a good lawyer is 30days county jail (best bet) or 1yr probation (Florida will bend u over and ram u) if violate probation you will 7 out of 10 times you will just start probation over or possibly jail time depending what you violate for. I see most people in county are a violation of probation so you have to make sure you think of what your going to do. Also is your friend your co-defendant or you both have your own charges if he is your co-defendant only 1 of you will have to take the charge
