No Breathalyzer, the Cops Still Have a Case
I was at a party that got busted. The cops talked to us all individually. I had been drinking that night, but by the time the cops showed up, I was sobered up, so I know I wasn't showing signs of being intoxicated. However, after he finished asking me for my personal information, he asked me what I had to drink. I figured at the time it would be easier to just be honest with him, so I told him what I had. He then had me sign a slip and I now have a court summons.
He did not give me a breathalyzer test, though. I am just wondering if there is anyway I could plead not guilty on lack of proof or something.
Additional details: He took pictures of the house, and pictures of us individually. I live in Maine. I got charged for "Illegal possession of alcohol by minor." (Title 28a / Section 2051)
Also, would it be easier to just plea guilty? If I attempt to plea not guilty, will it make my consequences worse?
Re: No Breathalyzer, the Cops Still Have a Case
you are a minor. You do not have to show signs of intoxication. It was apparently obvious you had been drinking and then you admitted to it.
You are a minor. No alcohol is acceptable in most states (which you conveniently failed to include). As such, most likely the charge is legit.
Re: No Breathalyzer, the Cops Still Have a Case
I agree.
You confessed to the crime. A breathalyser was not necessary.
