    The Petty Offense Exception
    Hi,
    Under immigration law, one of the exceptions to deportation is the petty crime offense, where the offense is less than 6 months of jail and the max sentence is less than a year.

    1) Does probation count as jail? Say it is a misdemeanor theft and it was 11 months and 29 days of probation, does this still count as petty crime offense?

    2) Can petty crime offense be used twice?

    1) Yes, it still counts as a petty theft offense.

    2) No. The petty theft exception may be used only once.

    under immigration laws, anything such as fines, probation will count as conviction. one CIMT with max possible sentence of less than one year or actual sentence of less than 6 months will count as petty offence exception.

    two or more CIMT anytime will get u deported.
