My question involves landlord-tenant law in the State of: Quebec, Canada
A sub-tenant took over my lease, but moved in a half month early. Because he moved in early, I was responsible to get the half month rent from him along with the security deposit for the fridge & stove. My sub-tenant had his parents co-sign the lease with the landlord, but there was no written agreement between us at that time.
After threatening to take him to court, I received a letter from his Mom stating that they were not willing to pay me what I was requesting because the fridge was rusty and dirty, the walls should have been repainted, the carpets needed changing and the windows needed cleaning and the bathtub was in poor condition. (prices were listed for each cleaning/repair) She agreed to pay me for the fridge & stove deposit if I could give her written proof from the landlord that the money would be returned to her upon her son leaving.
I got the written proof from the landlord, but I did not forward it to her because I was worried about accepting a partial payment as the court documents had already been filed. In my defense, the fridge was rusty on the outside (but it's a rental apartment and that's a landlord issue), the windows did need cleaning on the outside only (that's a landlord issue), and the carpet and bathtub were clean and I had lived there for a year. The son had seen the apartment on two occasions before signing the lease with the landlord.
They had paid the landlord on time every month (the landlord also had their social insurance numbers a.k.a. social security numbers), but never did pay me anything. I tried to subpoena the landlord, but the landlord sent me a letter stating that she will be on vacation so she will not be able to attend the court date. The landlord had told me that she refuses to take keys from tenants (she took mine) unless the place is in good condition.
My Mom is appearing in court on my behalf, and she was witness along with two other family members to the good condition in which I left the apartment. I do not have photos.
Question:
I realize that my case is in Canada, but just from a logical perspective, what will the result be?
