Child Custody

My question involves a child custody case from the State of: Louisiana

My husband would like to seek custody of his son who is 9 in the 3rd grade. He is paying child support and had to file for visitation which the mother still does not honor all the time. Well she told us that the son passed to the 4th grade but obviously by his grades he did not. He had stated to us that no on helps him with his school work and he has mentioned other things that the mom has done to him.

He stayed with us for Christmas...based on visitation paperwork and she called the police and said he had been kidnapped. While he was with us I taught him how to spell his middle name, his address and phone number and family members real names....yes and he is again 9 (NINE).

We would like to seek full custody of the child be financially we can not afford a lawyer due to me working part time and finishing college and my husband providing support for us and paying child support. I will finish school in December which I plan on becoming a teacher.

We really need to seek custody because in 4 years he still wears the same size clothes and his foot have gone from a 1 to a 1.5 since 2005. He has a constant runny nose which tells me he has allergies but she doesn't take him to the doctor. PLEASE HELP!
