Father Stole My Education Fund
My parents recently divorced, in which I learned my father 3 years earlier closed my education IRA by signing his name and forging my moms. Divorce laywer says there's nothing left and nothing can be done. Now I'll be graduating HS in one year with nothing. Can I sue my father for the amount of this fund (which was large enough to pay for 4-yrs of school)? My state is TX
Re: Father Stole My Education
You might want to double check the source of your information. Educational IRA's with designated beneficiary's typically can NOT be cashed out by the parents. The institution where this account was held should be able to provide information about how such accounts could be closed, but those accounts are made to NOT be able to do what you're suggesting - they are closed access as far as the trustee (your parents).
Other possibilities are that it was some OTHER type of account, or that dad moved or otherwise secreted the account.
