NCP was allegedly supposed to return from South Korea in Jan '09 (he's not military) but now he could be in Timbuktu for all I know. WI dismissed the case for lack of jurisdiction (South Korea not a party to the Hague Convention).
So...I've tried all I can. NCP refuses to submit to WI jurisdiction, NY refuses to take it, and I'm filing in WI for a TPR on grounds of abandonment and failure to perform parental duties.
My question: what is considered evidence of abandonment when NCP has never done anything? I have a slew of emails attempting to communicate with him...Any advice would be much appreciated.
Also (if you're still reading) wondering if anyone has had experience using the US Marshal's form for Overseas Process Service.
Well, I went down to the courthouse yesterday since no one was returning my calls...we have a hearing scheduled for the 26th June...they seemed irritated that I went down there (and that I'm doing this pro se, but I can't afford an attorney) and told me they were working on the paperwork...now I'm thinking I'm going to have to ask for a continuance if I can't get the service by publication done in time...:( )
