    My Manager Did Everything Wrong - How Long For H2B Approval

    Hey guys,

    I just want to start off by saying that I am in need of some help and truely I think the people on the board are very helpful and believe me im very thankful. My Employer applied for a Work Visa but he did it all wrong so now he has no idea what to do, I mean the guy has to ask me the questons and is way busy to get general information so he told me to get the forms and ill fill them out. So I downloaded two forms The "ETA 750" and the "I-129". The place that hired me is a Resterant in Michigan so I believe that my employer needs to fill out a "certificate from the Department of Labor" (ETA 750), once approved then I can apply for the "I-129". Now Im from Canada and I believe that you can NOT stay in the United States as a visitor while the forms are being filed. So really im confused, worried and truely need some advice.

    please correct me if I made any mistakes going through this process. I also want to point out that the only way Im allowed to visit the U.S. is using my Birth I.D. (just information to be passed)

    Once approved by the ETA 750, My Employer will apply for a H2B visa using the I-129 form, sending it in to the USCIS service office in Nebraska.

    Im wondering how long will it take til I am able to work/approved?, can I go straight to work after Im approved from the ETA 750 form (I understand that I have to file for the I-129 but can I work while thats being filed?)

    I really want to work and I was hired in January and truely I just want to live in the U.S. and truely WORK! lol.

    I appreate it if you can help me out ASAP.

    You can visit the U.S. while your employer processes the paperwork; you just can't work.

    yes, I understand that but I was wondering how long does it take for USCIS to allow me to work in the States.

    I also want to know if im doing everything right.

    You're on the right track, although it really should be the employer who files the documents. There are instructions on the H-2b application process here.

    Oh alright thanks!, ya my employer is going to do it but he just has no idea what he is doing so he wants me to come in soon to talk about it and go over the form with me...just incase he puts any incomplete info.

    I was wondering tho, how long will it take til Im approved/get the visa?

    WAIT ONE MORE QUESTON!!

    My Employer told me he called USCIS and looked up online and doesn't understand...

    the queston is...

    once the ETA 750 Form is approved, he goes directly to the I-129 and send that in but what does he include with the I-129 form?

    Please tell me what he needs to include...
