Penalty for Giving False ID to Officer
My question involves criminal law for the state of: OH
My brother last year got a DUI and currently has his license suspended. I am currently looking for auto insurance and was told yesterday by an agent that my license is suspended. I was floored b/c the last time I had a citation was over 3 years ago. Turns out... my brother, 6 months ago, got stopped by a officer for speeding (with a suspended license) and gave the officer MY information. He knew that if he gave him his info, he was going to jail. I don't know how my bro got the ticket b/c honestly I don't think he had my ID and I'm sure he doesn't know my SSN. But what is really bizarre is that we don't have the same eye color so the officer should've noticed. He didn't even tell anyone that he got a ticket using my info.
I am in the process of trying to get this off my record, because in fact I did not do the crime and I am furious with him. What kind of penalties is he looking at, mind you... DUI, suspended license, falsely saying he was me when I wasn't even in the state at the time.
Gosh, I am so mad, now I am not allowed to drive!
Any advice/comments would be great

To prove it was not you, you will need to contact the police and have your brother arrested for identity theft.
Any other charges are up to the DA.
