22349(A): 96mph at 65mph Limit
My question involves a speeding ticket from the State of: California.
Hi,
I am 28yrs old, live in NY, hold a driver's license from New Jersey and have a clean record so far. I do not have a car, but rented a premium size car for my vacation in CA. I got a ticket on 5/26/2009 for speeding at 96mph on a 65mph limit road in California (I - 580 W/B coming down the hill). The violation is 22349(A) VC Max Speed(65).
The cop said, I should receive something in the mail.
I did some research on google and on this forum and got to know that following is what would happen in my case (as per http://www.courtinfo.ca.gov/referenc...05JCBail.pdf):
1. Fine of $350
2. Addition of 1 point to my driving record
Can anyone confirm if that is correct? If not, what exactly will my punishment be? Is there a possibility of minimizing the penalty (especially, avoiding the point)?
This forum has been of great help and I would appreciate if someone could help me. I am willing to contribute once I handle my ticket

You will receive something in the mail assuming the officer asked you for and that you provided your current/correct mailing address. That "something" is referred to as a "Courtesy Notice" and although the court is under no legal obligation to send it out, it is printed once the citation is entered into the court system and they do mail them out regardless of the recipients home state or violation.
The application of the 1 point is reflected on your CA driving record. I'm not sure what that translates to on your NJ record and I am sure NJ will become aware of the violation.
California does allow violators to take a traffic school course to have the citation dismissed, however, in your case, and due to the fact that you were cited for allegedly exceeding the limit by 31mph, you lose the chance of automatic eligibility to exercise that method. Instead, you would have to personally appear in court and request that the judge allow you the opportunity of attending traffic school.
I am not sure whether you are still in California or not but you should also bear in mind that due to the fact that you are facing a charge of exceeding the limit by 25mph over the limit (31 to be exact) your violation might also be subject to a "Mandatory Court Appearance", and you will be notified of that via the Courtesy Notice that you should receive.
A Mandatory Court Appearance is just that; meaning you MUST personally appear before a judge or have an attorney appear for you. The fact that you might no longer be in California is not a valid excuse for not appearing nor will the court be satisfied with a "letter explaining why you can't appear" like some people on here might suggest.
