    My question involves criminal law for the state of: Ohio

    Ok, before I start understand that this situation is for a close friend of mine. He is a little misguided so I try to help him out when he needs it, but he may have not told me the entire story. Yes, this is for a friend and not me. I didn't even know he used drugs until he told me this morning.:wallbang:

    From what I understand he left my house at around 11:00 (he told me he had to see his dad, but that wasn't true) to meet some friends (16 and 17 he is 18 or 19, I forget). They decided to drive to a nearby park, forgetting they close at dark. From what I understand they got to the park and an officer stopped them, I don't know if he was driving at the time or not. He found a scale with marijuana residue in the trunk of his car.

    From what he told me the officer started in on them yelling about 4 charges, 3 misdemeanors and a felony but he says he couldn't remember what the officer had said.

    What could those charges have been, and what kind of time is he facing for the given evidence?

    They didn't have any marijuana on them at the time

    They were in the vehicle but it was turned off

    I told him to get a good lawyer (He has a steady income from the government after his mother died)

    I'm just worried about the punishments he may be facing, I don't want to lie to him, but telling him he is going to jail isn't going to help anything.

    He keeps telling me details that you may want to know;

    After the Officer stopped them his parents came and picked them up.

    His potential penalty depends upon the exact charges he faces, which you haven't told us, the terms of any plea bargain he enters, and his prior record. He should be talking to the lawyer you told him to get.

    I talked to him yesterday. He spent the entire day waiting for a call from the police to tell him when to be at court, but it didn't come.

    In more or less his exact words "The cop didn't even know what I was going to be charged with. He said he was kind of new and it was the first time he had been out on his own. He was also going on vacation the next day so he didn't file it right away."

    The "New Guy" thing makes no sense to me, but his father showing up and confirming it means its probably true. He talked to the lawyer yesterday too who said it was weird.

    When i got in trouble for this i got a fine and 4 months of unsupervised probation, Most likely you will get the same. Its not a big deal really, Just dont break the probation.

    Talked to him again today, he still hasn't had any word from the police.

    He added that there were actually 2 officers there at one time, one arrived after he had been caught, when he exactly arrived, I don't know. But apparently the officer that had arrived made a concerted effort at antagonizing him, making up a story randomly ending in finding a "scale with residue" on a bum, and screaming at him after he had asked permission to ask a question.

    Again, I don't know how much of it is actually true, given his state. I am working under the idea that everything after his dad showed up is true, and anything before may or may not have happened.

    Either way, I don't know much about police procedure, but that doesn't seem very professional. And it has been well over a week since the incident and he still hasn't heard anything from the police. Is this strange?

    Also, thanks Stupidlawbreaker. I'll let him know what he may get hit with.

    It's been about 2 weeks since the incident and he still has yet to hear from anyone. I told him to wait until next wednesday to call his lawyer.

    It has been several weeks since the incident. Is it safe to say at this point that no action will be taken?
