Possession in a School Zone
I am in Texas, charged in Texas.
I got charged with "Possession of a Controlled Substance Penalty Group 3 less than 28 grans in a Drug Free Zone". I went to see the Jevenile probation officer about 2 months back, he told me I would be going to court at the end of the month (March). It is now nearly the END OF MAY! I just got a letter in the mail that says:
Deferred Prosecution has been recommended fior the final disposition on the above named child's case of Possession of a Controlled Substance Penalty Group 3 less than 28 grams in a Drug Free Zone, Please contact this office for an appointment so that this matter can be handled.
What exactly does this mean? I have no idea?? Am I going to court or not? What are they saying I need to do? By the way, I am 15 years old. First offense of anything ever! What am I going to get?
Thanks, Derick
Re: Possession in a School Zone
it sounds like you are getting really lucky and they are going to offer you a deferred judgment. That means essentially, if you follow the rules they place on you, this will disappear.
It then states that whomever the letter is addressed to must call the court as directed to set a time where this will be discussed.
as to what you are going to get, besides lucky?
probably probation and maybe some community service.
where are your parents? they most likely will have to attend with you.
Re: Possession in a School Zone
WOW! Thanks VERY much! Do you think I will get a license suspension for this? I am looking forward to getting my driver's license.
If a driver's license suspension is normal for something like this, is there a way to get more community service or something is return for my driver's license??
My parents can attend whatever needed.
Anything else you can let me know on this situation?
Do I need to go in front of the judge still?
Lawyer needed?
Thanks, Derick

I do not know on the license suspension.

You might ask but surely you do not want to get pushy.

good. that is very important.

I have seen states that require a judge to rule and as such, you would be faced with a judge or I have seen states that this all simply becomes a bunch of paper work. I would plan on seeing the judge. They generally like to impress on you just how lucky you are that you are being given a second chance.
rarely a bad idea to have an attorney. If you can afford it, it would surely be in your best interest at least speak with an attorney to guide you.
