Can I Move Out

This concerns the state of : Florida.

I am 17 years old I will be 18 next April. I have a son who is 4 months of age. I was wondering, if you live in Florida and you have a child are you considered an adult? Because I want to move out of my home. My brother is all into drugs and is going to court and jail alot, still living at home and he is 22. Has a kid of his own. He brings his drug dealer friends around and comes over here high all the time. I have a boyfriend, he is 19 and has a job. He is willing to support me and my son. We would be living with him in a 3 bedroom 2 bath house, also with his cousin. All my mother does around here is complain. She even calls my son her kid?! Is she serious? I don't want him to grow up calling her mama and thinking that I'm not his Mom just some girl that's related to him. My mother is not very stable right now. I really don't want my son Adrian growing up in this situation. My mom doesn't want me to move out ever, honestly. But she will settle for me being out college. I will be in college for about 8 years. I start next year for being a lawyer. My mother lives in a 2 bedroom 1 bath house. I don't want to have my son sleeping with me until he's 5-8 years of age. He will be so used to it by then, he will want to do it all the time. HELP?! I am also willing to get a job to help my boyfriend, I have friends and family who will watch my son for me. I would also apply for WIC, Food Stamps, and all that good stuff.

No, you cannot without your mother's permission. No judge is going to emancipate you so that you can go play house with your boyfriend.

Get a job and save up for when you turn 18 and move out.

WOW!!! WIC, Food Stamps, and all that good stuff??? Are you kidding me?

Like I wasn't looking for mean remarks.. I just don't want my son growing up in a horrible environment like this. Like I have. I don't want to play house, I'm taking everything serious, whether you believe me or not. I graduate High school a year early just for my son, and I'm going to college sooner than I planned for him.

But thank you, that helps. I guess I'll just wait till I'm 18.

As stated you can leave when you turn 18. Having a child only medically emancipates you.

I think it's great that you want to better your life for the sake of yourself and your son but you need to think things through more realistically. Having goals are great, I hope you do well in college. Having goals to get on welfare are not great. Those services should be used by people who desperately need them not those who are in a hurry to get up and go from an available home.

Get on the ball now to get a job and save it all so you will not have to rely on others to take care of your families immediate needs. The world is not kind in the least bit, especially now. If you and your son need to share a room, so be it a lot of parents have done it and still do so. It's life. You do what gets you by. Look at your brother he moved out and ended up moving back home. It's not easy but I do wish you luck.

Not exactly. While a minor female is pregnant, she can make medical decisions for herself, if those decisions affect the pregnancy.

Once the baby is born, the minor parent cannot make her own medical decisions, as she is a minor and will require parental consent for all medical procedures. At the same time, the minor parent can make all medical decisions for her child, as she is that child's parent, even though she cannot make decisions for herself.

As to the OP:

You cannot be emancipated if you are on public assistance, or if someone else is supporting you. If you want to go to college, my advice to you is to learn to keep your legs closed. College s hard enough without a flock of children to care for. The odds are overwhelmingly against you. Good luck.

That's why you don't HAVE children when you are IN such an environment. You wait until you are old enough to get OUT and support yourself AND the child.

What on earth could she POSSIBLY have to complain about - except two children who are off making children of their own - and HER paycheck is putting the roof over most of their heads. Who paid for your last 10 meals? Who bought the last 10 packs of diapers for YOUR child? Who pays the bill for the electricity or paid for the computer you used to write your post? Who had the credit to GET utilities turned on in the first place? Despite what you think, someone other than YOU is responsible for those things - and whoever THOSE people are GET to bitch about it.


If you suspect that your brother and/or his friends have drugs in the house, call the police and give them what information you can. And try to talk some sense to your mother - at 22 your brother NEEDS to be on his own. Not sucking dry resources that the family needs to support YOU and your child (for another year).

I would also apply for WIC, Food Stamps, and all that good stuff.

And the MINUTE you indicated this, the judge's response would be, Petition Denied.

Children do not get to move out so that they can become a drain on the taxpayers.

everyone here is correct in saying that you can not legally move out while you are still a minor. however, being a young mother myself, i was in a similar situation. my suggestion as much as you don't want to hear it is to work hard, work alot and save every cent you get. the more money you start off with, the better you will be. grit your teeth and bare it. dont let it get you down because what you will go thru in the next year will pay off when you are able to move out. good luck with your emancipation... it seems like a process that requires some pretty horrible living conditions in order to go through with. if anyone on here has the time.. please review my post.. to see if i may be eligible for an emancipation.. and what i would need to do in order to go through with the process! thanks so much!

Your living conditions are not a factor.

Emancipation is not about "My home life sucks". Emancipation is for minors who find themselves needful of the ability to enter into contracts and manage their own lives, who have been supporting themselves 100% due to circumstance beyond their control.

Read the stickies at the top of the forum. They're there for a reason.
