My question involves a child custody case from the State of: Florida
Ok, I am married and really want a divorce. We have been separated for a year now and have a 2 1/2 year old son together. I want to move out of state (to Missouri) and I know he doesn't want me to. I have no job and neither does he. I have family in Missouri who are willing to help me there. My husband has a pending child abuse case with his girlfriends' child, he only sees our son periodically, and never for as long as he 'plans'. There is no written custody agreement or anything like that....
My question is can I move without having him sign anything, can I just inform him? I don't know what to do....:wallbang:

You need permission if there's a custody or visitation order in effect, or if a divorce is pending in court. If you're informally separated - you or he just moved out - with nothing filed in a court, there's no legal reason you can't move. But it's a huge risk, as during the six month period after you move your spouse will be able to litigate custody and visitation issues in Florida, and courts are generally not pleased when their introduction to a custody case is, "My spouse just moved with our kids to another state without my consent."
