Can Arrears Order Be Increased
My daughter recently turned 18 years old and my current child support order will stop once she graduates from high school (next month). Her father is over $10,000 in arrears and the court order for the arrears is $50 each month. We live in Virginia but the order is governed in Maryland. My daughter will be a full time college student in the fall. My question is can the court order for the arrears increase to at least the amount of support I am receiving now?
Re: Can Arrears Order Be Increased
The court will have assessed the payment toward arrears based upon your ex's ability to pay, and perhaps also state or federal limits on wage garnishment. We don't know enough about the case to guess whether the court would revisit that assessment, but if the ongoing support order is ending it seems possible that the court would increase the payment toward arrears.
