    :confused:My question involves criminal law for the state of: California

    I have been accused of Grand Theft PC 487 (a). There was some money that was put into my bank account however not by me. I subsebquently spent the money not knowing where it came from. What type of defense would I be able to present?

    You tell us. The argument, "Somebody stole a check and put it into my account" isn't very convincing. That's what we're talking about, right?

    No, not at all. I'm trying to figure out what angle I should prepare my defense. No checks involved. There was money that was transferred into my account by a third party. I spend the cash. however am not the one that put it there. I just wanted to defend myself against the prima facie case of grand theft. I did not put the funds in my account. Therefore not theft ?
