Scary Subtenant Won't Leave After 30 Day Notice
My question involves landlord-tenant law in the State of: California
My question involves a roommate in the State of: California
I gave a man subletting a room in my SF flat 30 days written notice. He signed and agreed to move out by May 7th. It is May 6th and he has stated that he has no intention of leaving. I already have someone moving in the the space in 2 days because I assumed the room would be vacant. What are my rights, what are his rights?
He is a hot-tempered man who has admitted to hitting my dog! I want him out, I do not feel safe. My landlord does not speak English and will not get involved. Can I call the cops? Do I need a lawyer? What do I do?
Also, I said that I would give him his full deposit back when he moves out on the 7th. He has not paid for a day of rent past the 7th. If he stays longer than he said he would, am I required to give him his full deposit? Do I charge him to stay? Since someone is moving in who has paid for rent from the 7th to the end of the month and he has not, what can I do if he is still in the space? What a dilemma!
