    Changing the Last Name on the Birth Certificate
    My question involves name change laws in the State of: Florida

    I will try to keep this short. My sons father was in jail for theft while I was pregnant, and is a habitual drug offender, my sons last name is mine. He is now a year old and the father is out, he has already relapsed twice. He wants our sons last name changed to his, and to be added to the birth certificate. What legal rights would he get if I were to sign his last name over? Also, I need to know if he files for custody, will he be able to prohibit me from moving away with my son, if I were to agree to "joint custody" or should I fight for "sole"?
    *Dont know if it matters any but he will be on probation for the next 10 years and owes over $30,000 in restitution.

    Are there any court orders that established paternity?
