Joint Property Ownership
My question involves personal property located in the State of: Texas
In 1997 my Mother bought a small piece of property with a trailer on it. She had it titled in her name and mine. Example: Wanda Smith and James Smith. She is now in a nursing home. Her will states my sister may live there as long as you wants, with no conditions. My question is when my mother passes away does this property become mine or is it divided between my sister and I. My sister says, she can rent it or do whatever she wants with it since she has power of attorney over everything? My sister ran up over $18 thousand dollars worth of credit card bills and abused my mothers bank card. All caught on camera, without my mothers consent. When confronted at the bank with my mother my mother would not fill charges. Since then my mother has not spoken to my sister. What are my options, I do NOT want my sister or her 40 year old son who refuses to work living there after what was done to my mother. Please help.

It doesn't say "as joint tenants" or "as joint tenants with right of survivorship"? It's quite possible that you have a half-interest, and that the other half will end up in your mother's estate.
