    My boyfriend got into a verbal argument with two men and ended up pushing both of them,and in the end was charged with battery(without injury) one count for each man.
    He has had battery charges in the past (9 years ago when he was 18) because of the previous charge the new charges are now felonies.
    I have 2 questions, the first is how relavent are the previous charges going to be on the new charges? Obviously there has already been a big difference in the charge but I am more concerned with the possible sentencing/probation etc... I don't know if they take into consideration the 9 year lap or if they just look at the "repeat" offense.
    Second question is will it mke any difference in court that the men in their statement to the police said there were no injuries and it was not something they wanted to pursue or did not want anyone arrested for?

    If your boyfriend is facing felony charges, he should consult a criminal defense lawyer.

    The prior charge has already escalated the present charge to a felony. It, along with any other criminal history, will factor in to a possible sentence. The court will likely consider the extent of injuries (or lack thereof) at sentencing as well.
