Can I Get Emancipated While I'm a Runaway
My question involves emancipation laws for the State of: Texas.
I am a fifteen year old run away, i have been away from my home now for about a week, and I have a place to stay and am about to get a job. I turn sixteen in two months and would like to be able to leagally stay away from home.
Their is no physicall abuse at home, only mental, I have been in the hospital seven times because my dad/ mom has worn me down, I believe that I am able to stay on my own, Would a judge grant me emancitpation?

The fact that your response to stress at home is multiple hospitalizations is going to be a huge red flag for the court that your coping skills aren't at a level of maturity where emancipation would be beneficial to you. Add to that the fact that you're a runaway, and there's no court in the land that will emancipate you. Emancipation is for those who NEED it (meaning if you have legal guardians who provide you with food, clothing, relatively clean surroundings, running water, flushing toilets, a roof over your head, and no physical abuse, you don't NEED emancipation). A "place to stay" means nothing - the court wants to see that you are able to AFFORD a place of your own, that YOU pay for, and could afford to pay for all by yourself if no one else was around.
Second, Texas won't even consider emancipation until you are 16, AND you'd need to show a track record of already HAVING a job that earn you enough money to pay ALL expenses of life, while at the same time maintaining your grades above average and on track to graduate high school on time.

To add: the people that are letting you stay with them are risking criminal prosecution for harboring a runaway.

AND - you can't get a job without a work permit, which your parents must sign off on.
No, I don't think you're going to get very far in any emancipation attempt.

And if the "place to stay" involves an adult boyfriend, he is, most likely, going to prison.

That, right there, is a 100% guarantee that you will not, now or at any time in future, be emancipated by a court.
