My question involves criminal law for the Province of: BC, Canada
I was out at a bar and had a disagreement with a bouncer. He physically removed me from the premises, without resistance. Once I was out of the bar he told me to leave or he'd summon the police. Upset with the manner I was removed, I asked him to summon the police b/c I thought they would at least listen to my side of the story. However, I did not realize they could arrest you just for being thrown out. I received a misdemeanor of public intoxication and spent the night in jail. I was fully cooperative with the police. Here's my question, how could they legally determine I was intoxicated without administering any tests? Secondly, I was in the bar for about 3hrs, and the bartenders never once refused my service. How can the bar serve me alcohol then have me arrested for public intoxication??? I have 30days to plead my case. What are my chances for getting this dropped and how should I approach it?
