Supporting a child with my last name
please help me? i was married in 1990 and had one child with my wife. we separeted shortly after marriage. divorce was final in 1993. well she had 3 more kids to two different fathers but used my last name for the other three that are not mine. can she do this? here's my next problem, she began to recieve cash assistance after our daughter was born. she has gotten over 16,000.00 from welfare and i was made responcible to pay this all back. they never went after the other fathers. i called welfare and spoke to a supervisor and told him i only father one child, why am i paying all these arears back for a whole family? he said well they all have your last name and he told me we dont split up familys on cash. i told him also she has the one father living with her for over ten years ,and hes been in and out of jail for not paying support to another woman.why isnt welfare going after these other dads? what can i due? i feel im being frauded!!!! and i feel its because they have my last name! i feel welfare has gotten to much money fom me for only one child what can i do? shes constantly on and off cash assistance and my daughters 15. and i have paid faithfully for 15years and i have the proof, beacause they always take it from my paychecks.

How did you come to have a support order entered against you by a court, for the two children born after the marriage? Did you fail to appear for court proceedings?

the courts are only making me pay for one child on child support, but they had my arears at 16,000.to welfare for a (whole family). im only responcible for one child so why do i have to pay back all the arears. they never went after the other fathers. welfare and child support are two separte things. they child support is fine. its arears to welfare that are messed up. see the thing is she got a total of 16,000.00 from welfare. well she has all four kids on welfare and none of the other fathers have arears but me. i shouldnt be totally responcible fo the whole 16,000. in welfare arears. it should have been spilt amongst the other fathers. the 16,000. owed is from 1990 to present.

What normally happens is that the welfare portion does not increase your obligation. That is, using totally made-up figures, let's say you pay support of $300 per month and welfare pays $200 per month. If you make your payment on time, welfare takes $200 of the payment and passes along the remaining $100 balance to the custodial parent. If you don't make that payment you get a $100 arrearage to the custodial parent, and a $200 arrearage to welfare. It may well be that the welfare payment would be smaller if the mother had fewer kids in the household, but your obligation remains the same.
