How Will My Bankruptcy Affect My Spouse
My question involves bankruptcy in the state of: Virginia
I am married and I alone have filed bankruptcy. My husband has not filed with me. My bankruptcy has not been discharged yet and my attorney and i have not decided if i will file chap. 7 or 13 yet. Now, one of my creditors who was included in my bankruptcy (local hospital) has filed a judgement against my husband for bills that were included in my bankruptcy. Is he responsible for these bills? Is there a statute of limitations on medical bills in virginia?
thx

He may be responsible for the bills, for example, if he signed a contract with the provider stating that he's responsible, and possibly under your state's "doctrine of necessities". That should be described in the creditor's complaint.
What do you mean they "filed a judgment" - did he choose not to respond to their filing a lawsuit, and end up with a default judgment entered against him?
Yes, there's a statute of limitations that applies to medical debts. How many years are we talking about in this case?
