Mother and Child, Same Family Name After Divorce
A woman and a man get married. They had a child. They divorced. The father did not let the mother to keep his family name. Mother got back her own family name but the child has his father's family name.
I need a good explanation (psychology maybe) why the child and the mother should have the same family name.
I suppose it is better for the child to have the same name as the mother she lives with.

How old is the child. This is a very pertinent question. Also how much involvement does Dad have with the child? Why does the mother thing the child must have her name and why would it be in the child's best interest?

The woman came to me with this question: "Do you know some articles or research which proves that it is in the child's best interest to have the same name with her mother, considering that I am divorced".
The child has 22 months. I do not know details, I was only asking myself if it really is in the child's best interest to have the same family name as the mother has.
So, I suppose that my real question to you is something like this: Considering your practice in the law area, do you believe that it is in the child's best interest to have the same name as the mother has, considering that she is divorced and the father doesn`t really care. What if he cares?
I am aware that maybe I should post this question to a psychology related forum, but I want to know the legal point of view to.

I am not an attorney...Just a person with legal knowledge. If the father is agreeable to this then the mother will have no problem with the courts granting permission. If dad DOES have a problem with the name change, it is unlikely it will be granted.
I can't see how a child will have psychological issue because mom has a different last name. The idea is pretty absurd. Millions of children have different last names than a parent. One of MY children has a different last name...She hasn't ended up on a couch yet.
And why does mom think that child will be emotionally harmed from not having HER last name but won't be harmed by not having Dads last name.
And what if Mom remarries? Does she plan on changing the child's name to that guys name? And if THEY divorce and she remarries yet again...Another name for Junior??
