Burglary of Habitation While on Probation
My question involves criminal law for the state of: Texas
I'm a 20 year old male who was on misdemeanor probation for criminal trespassing (Class B) in County A. My current probation was already about to be revoked due to non-payment. A day before my PO had already set to notify the courts of my deliquency, I got caught with the burglary charge in County B (2nd degree felony burglary of habitation "forcible entry"). Everything that was stolen, about 2-3 thousand dollars worth of stuff at retail prices, has since been returned. I've already confessed to the crime so its no fighting the case in that matter. I just want to know what kind of time im facing. I know that 2nd degree felonies are 2-10, and I was already on misdemeanor probation. Is it anyway possible that I can receive a year or less in total jail time if I'm willing to take any amount of probation (even 10-15 years)? If not, what am I looking at? And can i run the 2 cases concurrent in jail time or probation?
County A jail time: 2 days for 1, 3 for 1 if you make trustee
County B jail time: 3 days for 1
Re: Burglary of Habitation While on Probation
You're potentially facing the maximum remaining time on the charge underlying your probation, and a prison term for the maximum time on your new crime. You need to be working with a criminal defense lawyer.
