    Accidentally Taking a Shirt Without Paying for It
    Recently I was shopping with a friend in a chain clothing store. I managed to drop the bag i was carrying and drop all my things out of it....i picked up my things and my friend and i were on the way....in my haste, i apparently put a shirt in it.

    We were leaving the store and the alarm went off. They found the shirt within it...and then said didn't believe me when I told them the story...of what must have happened. They said that the tag was removed, and that it was within my bag....but the way my bag closes thats the only way it stays shut... and why would i travel with my bag open?

    Never the less, they took my picture, todl me that I would not be allowed in teh store for 3 years,....i received a letter of a civil demand saying that
    "Damages take into consideration the value of the merchandise, wheter or not it has been damaged or rendered non-saleable, the costs of security, and any other resitution permitted by law."....then it said i should be expecting a letter explaining the amount of monetary damages....so i have a few questions....I was never arrested at the time of the incident...

    I am 22, have a clean record, and am in MA....so, what will occur?

    1. Will a court date be held?
    2. Will I only be fined?
    3. Any inormation would be appreciated!

    3. Will this be on my permanent record?

    It is possible that they will prosecute, but is impossible to determine from the information you have provided. If you were prosecuted, you would get a court date and your sentence would likely include both a fine and assessment of court costs. For a first offense, depending upon the judge and law under which you are charged, it is not unusual to get a period of probation, work program, and/or community service instead of jail time.

    If i received no citation, and there was no arrest will a summons to court still occur? is this usual?

    If they filed a police report, the report will be completed and forwarded to a prosecutor for review, and the prosecutor will decide if they should ask for a warrant. That can take some time.
