MIP in Oregon, Benton County
My question involves criminal law for the state of: Oregon
Hi, recently I received an MIP in Oregon. I am currently in a diversion program for a PCS I received(marijuana under an oz) and am wondering if this would break diversion. Under the terms for diversion it says that I must comply fully with the law regarding controlled substances. I read the Controlled Substance Act and believe that alcohol is not technically a controlled substance. Also, the officer wrote down the number 5.03.040.010.03 as the violation citation, and I couldn't find it anywhere when I was researching so if anyone could enlighten me that would be great.
Also, I thought that an MIP was just a violation in Oregon, but my mother told me otherwise. Is this true?

You're in a diversion program, for goodness sake. Get a lawyer.

I was in pretty much that exact same situation, although in North Carolina.
An attorney was able to allow me to just complete 30 hours of community service and my alcohol charge was dismissed and my diversion program was still fine.
