    For J1 extension and J1 to F1 transfer
    My current J1 trainee visa with company will expire in two month and I want to transfer to F1 visa. Although I applied already for home residency waiver, I am afraid I am not able to get it in two month.
    1. Does the one month of pack-up time for J1 would be legal stay if I transfer to another visa? Do I need to apply for this one month pack-up time?
    2. Can I apply for F1 visa in waiting for that J1 home residency waiver? During that period, is that legal stay, or I should go home to wait?
    3. If school is willing to offer J1 for me, am I legal stay once I submit the J1 program transfer application?
    4. My current company is willing to extend my J1, but my program sponsor company claim that the program length setup is fixed, they do not do extension. What should I do in this case, can I complain to ECA?

    My case is complicated, and I really need help SOS. Thanks

    Maintain lawful status. If you are able to secure a new visa during the remainder of your time in J1 status, or during the subsequent 30-day grace period, you should be okay. But if you don't, you should leave the country and re-enter once you have a proper visa. You may wish to seek assistance from an immigration lawyer.
