Keeping Our Home
My question involves bankruptcy in the state of: FL
My dr. said I owned $110.000 for medical bill, my ins will not pay. Can I fill bankruptcy and still keep the house, or I can sell the house then file bankruptcy . I don't want because of me making a mistake to have that surgery it's not getting any better. I am now disable. All my children making the house payment. I really don't have that much money to pay. Thanks for your advise

Re: Keeping Home
You would not want to sell the home before filing for bankruptcy protection, as that would turn the home into a cash asset. You want to avail yourself of your homestead exemption. Florida has a very generous homestead exemption that may well preserve all of your equity. You would be able to keep very little cash.
What you should do is consult a bankruptcy lawyer. The consultation should be free.

Re: Keeping Home
I did ask the lawyer, they said I'll losing a house if i fill bankruptcy, some of the lawyer said I don't need to do anything. If the dr sue me I can prove that I don't have any money to pay. But some said I have to pay the dr. So I really don't know what to do. It's not my fault the dr office never contact me. Now I make the appeal my ins said the account is close so there' re no way they can process the claim. Please advise my what I need to do now.

Re: Keeping Home
I'm sorry if I'm reading too much into your use of language. I infer from the way you write that English is not your first language.
It sounds like you're consulting a number of lawyers and are getting conflicting answers. I suggest finding a lawyer who speaks your native language, or who can provide you with an interpreter who can aid with communication, as I suspect that a lot of the confusion results from a breakdown of communication.
